PUSH’s Contract Not the Only Thing Expired, Disney May Continue Character

pushphoto1

This morning, as the PUSH scandal was reaching new heights, Jason Garcia, reporter for the Orlando Sentinel, tweeted that “Inventor and co-owner of PUSH says contract with Disney lapsed over concerns about intellectual property rights to the character.”  This got me (Jason Diffendal) thinking, I wonder if Disney’s lawyers figured out a way to do their own version of PUSH and not have to deal with contract negotiations with the current owner of PUSH.  Well, it appears that this just may be the reason that the contract with PUSH was not renewed.

PUSH the Talking Trash Can was registered for trademark protection with the US Patent and Trademark Office on February 11, 2000, and the trademark was officially registered on March 19, 2002 as Trademark # 2548953.

pushtrademark2548953

However, the laws and requirements pertaining to trademarks are not trivial, and one important requirement is that, in order to maintain ownership of a trademark, the trademark must be in common usage on a regular basis, and the owner must file paperwork attesting to this fact.  The particular law is Section 8 of the Trademark Act, 15 U.S.C. §1058.  Owners must file what is called a “Section 8 Declaration of Continued Use” between the 5th and 6th years after the registration date.  For PUSH, that would have been sometime between 2007 and 2008.   The USPTO will cancel any registration on either the Principal Register or the Supplemental Register if a timely §8 Declaration is not filed by the current owner of the registration during the prescribed time periods. (Full details here.)

Searching the USPTO’s Trademark Database for the current status of this trademark, I found this ominous statement: “Registration cancelled because registrant did not file an acceptable declaration under Section 8.”  So it appears that PUSH’s owner failed to file the proper paperwork in 2008 to maintain ownership of the trademark, and so the registration was cancelled on December 27, 2008.  This unfortunate turn of events means that PUSH is no longer owned by “Robot Productions, Inc.” (Note that the company has apparently changed their name since then.)

As I mentioned at the beginning of this article, it is entirely possible that Disney’s lawyers discovered this information and thus determined that Disney could create their own version of PUSH without infringing any intellectual property belonging to Robot Productions, Inc.  Whether this is actually the case, I do not know, but certainly Disney’s highly intelligent lawyers have done things like this in the past, so it would not be a surprise at all if this turns out to be true. Stay tuned for more information as it becomes available.

Marvel “Iron Man Experience” Motion Simulator Coming to Hong Kong Disneyland

iron-man-experience-concept-art

Back in 2009, Disney purchased Marvel and with that came the rights to use the familiar Marvel characters in the theme parks. Disney has been hard at work for the last few years to bring those characters to life around the world in the theme parks. Disney has done just that today. Tom Staggs, Chairman of Walt Disney Parks and Resorts announced on the Disney Parks Blog that they will be bringing a new attraction to Hong Kong Disneyland in late 2016. The Iron Man Experience will be a new motion simulator coming to Tomorrowland based on the Stark Expo as seen in the second Iron Man movie.

Guests will begin their experience by seeing the evolution of the Iron Man suit and all the different forms it has taken. Guests will then board a ride vehicle which will allow them to take flight with Iron Man and help him fight the forces of evil. The Iron Man Experience will take place in the streets and skies of Hong Kong, so it’ll be familiar to those in the area. Additionally, you’ll be able to meet-n-greet with Iron Man himself within the new area in Tomorrowland.

Disney “Tomorrowland” Movie Begins Principal Photography

Tomorrowland, the Disney mystery movie that’s been teased for the past couple of months, culminating with the finale of “The Optimist” online and real-world viral campaign at the D23 Expo this month, began principal photography in Vancouver this week.

The movie, starring George Clooney and Hugh Laurie, directed, produced and written by Brad Bird, is about an optimistic, scientifically curious teen and a former boy-genius inventor who team up on a danger-filled mission to discover the secrets of a mysterious place that’s somewhere in space and time and that exists in their collective memory as “Tomorrowland.”

Director Bird has assembled a talented and award-winning team: Life of Pi Director of Photography Claudio Miranda, Star Trek & Star Trek: Into Darkness Production Designer Scott Chambliss, Inception Costume Designer Jeffrey Kurland, and The English Patient Editor Walter Murch will be on the film.

Tomorrowland‘s screenplay is written by Brad Bird and Damon Lindelof from a story by Lindelof & Jeff Jensen and Brad Bird.

Tomorrowland will be released in theaters on December 12, 2014.

New “Iron Man 3” Exhibit Coming To Innoventions at Disneyland

From Erin Glover on the Disney Parks Blog:

Attention Iron Man fans! To celebrate the upcoming release of “Iron Man 3,” opening in theaters May 3, an exciting new exhibit is coming to Innoventions at Disneyland park in California – featuring actual set pieces from the film!

Beginning April 13, Iron Man Tech Presented by Stark Industries will give Disneyland park guests the chance to see Tony Stark’s Hall of Armor, featuring Iron Man suits Mark I-VII – the same suits featured in “Iron Man 3.” And you will even be able to virtually “suit up,” yourself! Through simulation technology, guests will be able to see what it’s like to operate the latest pieces of the Mark 42 Iron Man armor, even getting the chance to test out its infamous repulsor blasts.

Iron Man Tech Presented by Stark Industries Coming to Innoventions at Disneyland Park
Come experience Iron Man Tech Presented by Stark Industries when it opens at Innoventions in Disneyland park April 13 – and then check out “Iron Man 3” in theaters May 3.

We also uncovered some additional information through a document released internally to Disneyland cast members:

  • The exhibit will run through September
  • Innoventions will not be closing for installation of the new Iron Man Exhibit
  • The Iron Man experience will not be replacing any existing exhibit in the building. (This makes us believe it will take up the space where Honda usually displays their vehicles whenever they are hosting a promotion at the parks.)

So, what do you think of this first installation of Marvel at Disneyland?

VIDEO: “Bling in the New Year” Kicks Off “Limited Time Magic”

Screen Shot 2013-01-02 at 12.28.34 PM

While celbrating New Year’s Eve at the Magic Kingdom, I decided to take in the first Limited Time Magic offering: the “Bling in the New Year” Dance Party at the Tomorrowland stage. It really wasn’t much different than the usual Club 626 dance party with the exception of some added dancers, different character costumes, and countdown to the new year which happens once an hour. We have a short video of the party to share with you:

Introducing… Disney PhotoPass Booths?

We’ve seen some interesting changes to Disney PhotoPass recently, but the most interesting has to be this booth I came across at the Tomorrowland Light & Power Co. Arcade:

I thought at first it was just a photo booth sponsored by PhotoPass, but is is more than that

You can scan a PhotoPass card

Not only can you print photos from the booth, but you can now access photos and video from the booth using your PhotoPass card

Pretty neat, huh? What do you think about Disney PhotoPass booths?
